<p>Speak to your lender as soon as you think you have a problem making your mortgage repayments. Do not let arrears build up before contacting your lender. The sooner you let your lender know that you have problems the better.</p><br /></div>

<h4>Your lender will treat you fairly</h4>
<p>Generally, lenders are willing to talk about your situation and help you find a solution. There is a set of conditions called the ‘pre-action protocol’, which your lender must fulfill to give you every chance to keep your home. If your case goes to court, you and your lender have to prove you have followed the pre-action protocol to the judge.</p><br />
<p>Your lender must:</p><br />
<ul>
<li>tell you how much you owe and any interest charges you’ll have to pay</li>
<li>consider a request from you to change the way you pay your mortgage</li>
<li>respond to any offer of payment you make</li>
<li>give you their reasons for turning down your offer of payment within ten working days</li>
<li>give you 15 working days’ written warning if they plan to start court action because you haven’t kept to a repayment agreement</li>
</ul>
<h4>How your lender can help</h4>
<p>To help you manage your repayments, your lender may:</p><br />
<ul>
<li>agree to change or lengthen the term of your loan</li>
<li>accept reduced payments from you in the short term</li>
<li>add any repayment debt to the amount you have borrowed</li>
</ul>
<p>You need to:</p><br />
<ul>
<li>show you are willing to make repayments you can afford</li>
<li>pay what you can, when you can, if you can’t afford the full payments at the moment</li>
<li>get a written copy of any repayment arrangement you make with your lender</li>
<li>keep in regular contact with your lender and let them know about any changes in your circumstances</li>
</ul>

<h3>Mortgage Rescue scheme?</h3>
<p>To be eligible your household must include someone in &#8216;priority need&#8217;. This could be:</p><br />
<ul>
<li>a pregnant woman</li>

</ul>

<p>You can also contact your local council directly to get advice about the Mortgage Rescue scheme.</p><br />

<p>When you apply for help from the scheme:</p><br />
<ol>
<li>the council will arrange for you to meet with their money advisers, if you haven’t already seen an adviser</li>
<li>you’ll get advice and a plan to help you manage your debt or some other way that you can meet your housing costs</li>
<li>the council may arrange an assessment of your home</li>
<li>you may get financial help, either with a ‘shared equity loan’ or through a ‘Government mortgage to rent’, depending on your circumstances</li>
<li>the council will involve a Registered Social Landlord (RSL) &#8211; an independent housing organisation registered with the Tenant Services Authority</li>
</ol>
<h4>Shared equity loan</h4>
<p>The RSL can provide an equity loan to reduce your monthly repayments. You’ll pay a low monthly interest-only charge on the loan. You’ll need to have at least 25 per cent equity in your property to qualify for the equity loan. This means your mortgage isn’t worth more than 75 per cent of the property’s value.</p><br />
<h4>Government mortgage to rent</h4>
<p>The RSL may suggest a Government mortgage to rent, which means the RSL will buy your home for 97 per cent of its market value. You’ll stay in your home and pay rent to the RSL as their tenant. The rent will be 20 per cent less than the market rate for your area.</p><br />
<p>You’ll continue to receive advice after you have entered the scheme to help you manage your finances.</p><br />

<p>Mortgages must be for a single-family residence with a loan balance no greater than $729,750, the home must be your primary residence, you must demonstrate financial hardship, and your mortgage payment must be more than 31% of your gross monthly income.</p><br />
<h2>What do you mean by &#8220;financial hardship&#8221;?</h2>
<p>You must demonstrate you don&#8217;t have enough readily available &#8220;liquid assets&#8221; to pay your current monthly mortgage payment. Be prepared to provide your most recent tax return, and two recent pay stubs.</p><br />
<h2>So, do I need to be behind on my monthly mortgage payments?</h2>
<p>Not necessarily, if you can show that your current income is no longer enough to make your payment because your other expenses have risen or you have taken a pay-cut, that maybe sufficient.</p><br />
<h2>I took a 30% pay-cut, but I have a large 401k, can I still qualify?</h2>
<p>Your retirement assets are not included in any determination of &#8220;financial hardship&#8221;.</p><br />
<h2>Are there any fees associated with the loan modification program?</h2>
<p>Unlike the refinance program, there are absolutely no fees associated with the loan modification program.</p><br />
<h2>How does it all work?</h2>
<p>Once it is determined that you qualify, service providers will be required to follow a sequence of steps that modify the loan in order to reduce the monthly loan payment to no more than 31% of gross monthly income. For example, the interest rate can be lowered to as low as 2 per cent and the term of the mortgage can be extended to a maximum of 40 years in order to maximize the reduction in loan payment.</p><br />
<h2>How long does the modification last?</h2>
<p>Any interest rate reduction will remain in effect for five years. Your rate will then increase by one percentage point per year to the Freddie Mac Primary Mortgage Market survey rate at the time of your loan.</p><br />
<h2>I also have a second mortgage, can I get it reduced or removed?</h2>
<p>Anyone who has their mortgage modified under this program will have the chance to have their second mortgage forgiven if they make timely payments for three months. The program states that the Treasury Dept. will actually make a cash offer to the owner of the second mortgage to forgive the debt. The lender can refuse the offer, however there is a good chance they will accept since they are likely to receive more money this way than if the home went to foreclosure.</p><br />
<h2>I heard that there are incentives to make timely payments, is that true?</h2>
<p>Yes, homeowners who make their mortgage payments in a timely manner are eligible for $1,000 reductions in the principal of their loan every year for five years.</p><br />
<h2>How do I get started modifying my loan?</h2>
<p>The easiest way is to answer a series of qualifying questions at the FinancialStability.gov web site here: <a href="http://www.financialstability.gov/makinghomeaffordable/modification_eligibility.html">www.financialstability.gov/makinghomeaffordable/modification_eligibility.html</a>.</p><br />

<p>The worst thing you can do is not to tell your lender you are having problems. Mortgage lenders are keen to help their customers sort out any payment difficulties. In many cases theywill be able to come to a payment arrangement with you.</p><br /></div>

<h4>If You Can&#8217;t Make The Payments</h4>
<p>Depending on your credit history and depending if your difficulties are likely to be long or short term, your lender could agree to:</p><br />

<li>reduce your payments for an agreed period</li>
<li>charge you interest only for a while for an agreed period, if you&#8217;ve got a repayment mortgage (usually you pay capital and interest)</li>
<li>give you a fixed term &#8216;payment holiday&#8217;</li>
<li>extend your mortgage term to reduce your payments</li>

<h4>If you&#8217;re already in arrears</h4>
<p>If you&#8217;ve already have arrears, your lender could suggest a way to pay off the arrears gradually, alongside your usual payments. If you can&#8217;t meet the extra payments, you may be able to delay them for a while or add them to your loan. Again, it depends on your track record. Don&#8217;t delay in contacting your lender!</p><br /></div>
<h4>Always pay what you can</h4>
<p>Pay as much as you can manage every month. Keeping up regular payments (even if they vary) shows that you&#8217;re committed. Your lender&#8217;s more likely to treat you sympathetically and you&#8217;ll minimise the arrears charges too.</p><br />

<p>Do you have several credit cards that are charging you high interest rates?  Are your monthly payments to the creditors using up all of your available cash but aren’t reducing the balance you owe?  Do you rack up late fees and over-the limit fees on your cards, causing an overall increase in your balance?  If so, then you would probably benefit by consulting with a good debt management program.  Debt management is an excellent tool for you to use in order to get rid of that credit card debt once and for all.</p><br />
<p>Before deciding which debt management program to use, compare several of them side-by-side to see which one offers the best program.  If you are looking for an actual loan, you will want to compare interest rates, fees, APR’s, and loan repayment timeframes.  If you are looking for debt management programs, you will want to check out fees, success rates, and customer reviews.</p><br />
<p>Debt consolidation loans will provide you with a lump sum you can use to pay off all of your small bills and make only one monthly payment to the loan company.  You will want to get the lowest interest rate and, if possible, the shortest repayment time frame.  Whether you get a secured or unsecured loan depends upon your willingness and ability to provide collateral.  Secured loans will guarantee you a lower interest rate but will also put you in danger of losing your collateral should you default on the loan.  Unsecured loans will carry higher interest rates but will not require collateral.  Both types of loans are great tools for getting your debt under control.</p><br />

<p>No matter which debt management tool you use, be sure to abide by the contract signed by you and the agency.  Make all of your loan payments on time so that you won’t fall back into the same trap that caused you to have to get the loan in the first place.  If you sign a contract with a debt management program, be sure to make all of your payments to them on time as well.  They have to use that money you send them to pay all of your creditors and if you default on the agreement, then the creditors may decide to kick you out of the agreed upon program.  This can result in your interest rates being raised back up and the fees added back to your balances.</p><br />
